Prosecute in court, not on social media – Amidu tells NDC, faults OSP tactics

Martin Amidu has delivered a harsh critique of the Office of the Special Prosecutor (OSP), cautioning the National Democratic Congress (NDC) government against leveraging public opinion to target former Finance Minister Ken Ofori-Atta.

In an extensive statement, Amidu referenced historical instances to warn against prosecutions driven by political motives, highlighting the premature deaths of Victor Selormey (NDC) and Adamu Dramani Sakande (NPP)—both of whom passed away shortly after receiving health-related pardons.

He characterized these incidents as “collateral damage within the political elite.”

He argued that the current strategy employed by the OSP, led by William Kissi Agyebeng, to pursue Ken Ofori-Atta with an INTERPOL Red Notice reflects a troubling trend.

“The trial of former politically appointed public officials in the court of public opinion must cease, and I recommend that the NDC government start with the Ken Ofori-Atta case, ensuring he is presumed innocent and tried solely in a court of law,” he remarked.

Amidu suggested that the Attorney-General should take over the case from the OSP, utilizing powers granted under Article 88 of the Constitution, and delegate it to either the Ghana Police Service or the Commission on Human Rights and Administrative Justice (CHRAJ) for a “professional and impartial investigation.”

He cautioned that neglecting this course of action would exacerbate political division with possible implications for national security.

“The Office of the Special Prosecutor Act, 2017 (Act 959) does not supersede the provisions of Article 88 of the Constitution; otherwise, it would be unconstitutional,” he stressed.

Additionally, Martin Amidu advised that Ken Ofori-Atta could contest the INTERPOL Red Notice through the Commission for the Control of INTERPOL Files (CCF), citing political persecution and the potential for an unfair trial under the current OSP.

He condemned the OSP’s actions, claiming that they are politically motivated and detrimental to justice.
